By using DoppleNet’s managed redundant connectivity solutions ("Services"), you ("Customer" or "you") agree to be bound by these Terms and Conditions ("Agreement"). If you are entering into this Agreement on behalf of a company or another legal entity, you represent that you have the authority to bind such entity to these terms and conditions.
Your service will commence as soon as DoppleNet activates it, according to the specifics outlined in your Service Order Form. The initial term is set for 12 months unless otherwise stated on the form. Upon expiration, your service will renew automatically, ensuring uninterrupted connectivity. Note that the use of any services provided in partnership with T-Mobile obliges you to adhere to T-Mobile’s own terms and conditions. These can be found at their designated URL and may be revised from time to time; it is your responsibility to stay informed of these changes.
For the use of DoppleNet’s services, you will incur charges as specified at the time of your order. These charges will be exclusive of any applicable taxes unless required by prevailing law. It's expected that you use the services in compliance with our guidelines and not for any disruptive or unlawful purposes.
We reserve the right to modify both the services and these terms. Should changes occur, we will notify you through our website or directly, and these changes will become effective immediately upon communication.
DoppleNet's warranty is specifically delineated in the DoppleNet Service Level Agreement, which is updated periodically and forms an integral part of this agreement by reference. Except as expressly stated in the Service Level Agreement, DoppleNet disclaims all warranties, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose. Our liability is limited – we are not responsible for any indirect or consequential losses that may arise from the use of our service.
In the event of any claims or legal proceedings associated with your use of the services, you agree to indemnify and hold harmless DoppleNet, including its employees and affiliates, from such claims.
Communications from us will be sent to the email address you provided during your service setup. If you need to contact DoppleNet, you must send written communication to our headquarters at 5900 Balcones Drive, Suite 100, Austin, TX 78731.
This agreement is under the jurisdiction of Texas law, and any disputes will be settled in the courts of Travis County. This document encompasses the full agreement between you and DoppleNet, superseding any previous discussions or agreements.
Either party has the right to terminate this agreement if the other fails to uphold any of these terms. Neither party will be held responsible for delays or failures in performance resulting from acts beyond their reasonable control, such as natural disasters or labor disputes.
This agreement is personal to you and cannot be transferred without our written consent. If any provision here is deemed unenforceable, it will not affect the remainder of the terms. Additionally, a failure by DoppleNet to enforce any right or provision will not be deemed a waiver of such right or provision.
In accepting these terms, you acknowledge that you have read and understood them, and you accept the agreement in its entirety, including the incorporated Service Level Agreement and T-Mobile’s terms and conditions.
